TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) govern your access to and use of FTCWatercooling.com (the “Site”) and purchases made directly from FTC PARTS LLC, doing business as FTC Watercooling (“FTC Watercooling,” “we,” “us,” or “our”).

By accessing or using the Site, creating an account, placing an order, or otherwise using our services, you agree to these Terms. If you do not agree with these Terms, please do not use the Site.

1. ELIGIBILITY AND ACCOUNTS

You must have the legal capacity to enter into a binding agreement to make purchases through the Site.

If you are under the age of majority where you live, you may use the Site only with the involvement and permission of a parent or legal guardian.

If you create an account, you agree to provide accurate and current information and to keep your login credentials confidential. You are responsible for activity occurring through your account unless prohibited by applicable law.

Please contact us if you believe your account has been accessed without authorization.

2. PRODUCTS AND PRODUCT INFORMATION

We make reasonable efforts to provide accurate product descriptions, specifications, photographs, compatibility information, pricing, and availability.

However, manufacturers may change specifications, packaging, designs, included accessories, or other product details without notice. Images may also differ slightly from the product received.

We reserve the right to correct errors, inaccuracies, or omissions at any time.

All products are subject to availability, and displaying a product on the Site does not guarantee that it is currently available for purchase.

3. COMPATIBILITY

PC watercooling components frequently have specific compatibility requirements involving hardware models, revisions, socket types, GPU PCB layouts, tubing sizes, thread types, fittings, pumps, radiators, cases, and other components.

Customers are responsible for verifying compatibility before purchasing or installing a product.

Compatibility information provided on the Site is intended to assist customers but should also be compared with manufacturer specifications when appropriate.

If you are uncertain whether a product is compatible with your system, we encourage you to contact us before purchasing.

Purchasing an incompatible product does not make the product defective. Eligible compatibility-related returns are handled according to our Return Policy.

4. ORDERS AND ORDER ACCEPTANCE

Submitting an order does not guarantee that we will be able to fulfill it.

Automated order confirmations acknowledge that we received your order but do not prevent us from canceling or modifying an order when reasonably necessary.

We reserve the right to refuse, limit, or cancel an order for reasons including product unavailability, inventory errors, pricing errors, suspected fraud, payment issues, technical errors, duplicate orders, unusually large quantities, or other circumstances reasonably affecting our ability to fulfill the order.

If we cancel an order after payment has been collected, the applicable amount will be refunded to the original payment method.

We may limit quantities purchased by a customer, household, account, payment method, or address.

If you request cancellation after placing an order, we will make reasonable efforts to accommodate the request, but we cannot guarantee that an order can be canceled once processing or shipment has begun.

5. PRICING, PAYMENT, AND TAXES

Prices are displayed in U.S. dollars unless otherwise stated.

Available payment methods are shown during checkout and may change from time to time.

You agree to provide accurate billing and payment information and authorize the applicable payment provider to process charges associated with your order.

Applicable sales tax will be collected where required.

We reserve the right to correct pricing or calculation errors. If a material pricing error is discovered after an order is placed, we may contact you regarding the error or cancel and refund the affected order.

6. SHIPPING AND DELIVERY

Customers are responsible for providing a complete and accurate shipping address.

Shipping and delivery dates are estimates unless expressly stated otherwise. Carrier delays, weather, customs processing, service interruptions, and other circumstances outside our reasonable control may affect delivery.

Once an order has shipped, tracking information may be provided when available.

If an order is returned to us because of an incorrect or incomplete address, refusal, failure to collect the shipment, or another circumstance attributable to the recipient, additional shipping charges may apply before the order can be resent.

If you believe a shipment has been lost, damaged, misdelivered, or otherwise affected by a carrier issue, please contact us so we can assist with the appropriate carrier investigation or claim process.

Nothing in this section limits rights that cannot legally be limited under applicable consumer law.

7. INTERNATIONAL ORDERS

International shipments may be subject to customs inspections, import restrictions, duties, taxes, brokerage charges, or other fees imposed by the destination country or carrier.

Unless expressly stated otherwise at checkout, the recipient is responsible for applicable import duties, taxes, customs charges, brokerage fees, and similar charges.

FTC Watercooling is not responsible for delays caused by customs authorities or other governmental agencies.

Customers are responsible for determining whether products may legally be imported into their destination country.

8. RETURNS AND REFUNDS

Returns and refunds are governed by our Return Policy, which is incorporated into these Terms.

Please review the Return Policy before making a purchase.

Refunds approved under the Return Policy will generally be issued to the original payment method.

9. INSTALLATION AND USE OF PRODUCTS

PC watercooling products require proper installation and handling.

Customers are responsible for following applicable manufacturer instructions, verifying compatibility, using appropriate components, and properly installing and maintaining purchased products.

Where appropriate for the product or system, customers should perform reasonable inspection and leak-testing procedures before operating electronic components.

To the fullest extent permitted by law, FTC Watercooling is not responsible for damage caused by improper installation, misuse, modification, incompatible components, over-tightening, physical damage, contamination, failure to follow manufacturer instructions, or other use outside the product’s intended purpose.

Nothing in these Terms excludes liability that cannot legally be excluded.

10. DEFECTIVE PRODUCTS AND WARRANTIES

If you believe you received a defective product, please contact us so we can help determine the appropriate next step.

Certain products may be covered by a manufacturer’s warranty. Manufacturer warranty terms, eligibility requirements, and procedures are determined by the applicable manufacturer.

Unless FTC Watercooling expressly provides a separate written warranty for a product, we do not create or extend an additional manufacturer warranty merely by selling the product.

Nothing in these Terms limits warranty rights or other consumer protections that cannot legally be waived or excluded.

11. AMAZON PAY AND THIRD-PARTY MARKETPLACES

Amazon Pay and other third-party payment services may be offered as payment methods for orders placed directly on FTCWatercooling.com.

Using Amazon Pay does not make an order placed on FTCWatercooling.com an Amazon Marketplace order.

Orders placed directly through third-party marketplaces such as Amazon, eBay, TikTok Shop, or other marketplaces are governed by the applicable marketplace’s ordering, payment, return, and dispute procedures in addition to any applicable seller terms.

These Terms primarily govern transactions made directly through FTCWatercooling.com.

12. REVIEWS, COMMENTS, AND SUBMISSIONS

The Site may allow customers to submit reviews, comments, photographs, questions, or other content.

You retain ownership of content you submit. By submitting content for publication, you grant FTC Watercooling a non-exclusive, worldwide, royalty-free license to use, reproduce, display, format, and distribute that content in connection with our Site, products, business, and marketing.

You represent that you have the right to submit the content and that it does not infringe another person’s intellectual property, privacy, or other legal rights.

Reviews and submissions must not contain fraudulent, knowingly false, unlawful, threatening, abusive, defamatory, obscene, infringing, or malicious content.

We reserve the right to remove or decline to publish content when reasonably necessary, but we do not guarantee that all submitted content will be reviewed.

13. PROHIBITED ACTIVITIES

You may not use the Site to engage in fraud or attempted fraud; test stolen or unauthorized payment credentials; gain unauthorized access to accounts or systems; distribute malware or harmful code; interfere with the operation or security of the Site; create accounts or place orders through unauthorized automated means; scrape or systematically extract Site content without authorization; impersonate another person; submit intentionally false information; abuse our customer-service systems; or otherwise use the Site in violation of applicable law.

We may block IP addresses, accounts, payment methods, devices, or other access when reasonably necessary to prevent fraud, security threats, automated attacks, card testing, abuse, or violations of these Terms.

14. INTELLECTUAL PROPERTY

Unless otherwise indicated, content created or owned by FTC Watercooling on the Site—including Site design, text, graphics, logos, photographs, videos, and other original materials—is owned by or licensed to FTC Watercooling and is protected by applicable intellectual-property laws.

Product names, trademarks, manufacturer logos, photographs, specifications, and other materials belonging to manufacturers or other third parties remain the property of their respective owners.

You may use the Site for lawful personal or internal business purposes but may not reproduce, republish, sell, systematically copy, or commercially exploit our protected content without permission.

15. THIRD-PARTY SERVICES AND LINKS

The Site may interact with or link to third-party services such as payment processors, shipping carriers, manufacturers, social-media platforms, or other websites.

We do not control third-party websites or services and are not responsible for their content, availability, security, terms, or privacy practices.

Your interactions with third-party services may be governed by their own terms and policies.

16. PRIVACY

Our collection and use of personal information are described in our Privacy Policy, which should be reviewed together with these Terms.

17. SITE AVAILABILITY AND CHANGES

We may modify, update, suspend, or discontinue portions of the Site at any time.

We do not guarantee that the Site will always be uninterrupted, error-free, or continuously available.

Temporary interruptions may occur because of maintenance, software updates, hosting issues, security events, third-party outages, or circumstances beyond our reasonable control.

18. DISCLAIMER REGARDING THE SITE

To the fullest extent permitted by law, the Site and its general informational content are provided on an “as available” basis.

We do not guarantee that Site content will always be complete, current, uninterrupted, or free of errors.

Product warranties and statutory consumer rights are addressed separately and are not eliminated merely because the Site itself is provided on an “as available” basis.

19. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, FTC PARTS LLC and its owners, employees, agents, and representatives will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the Site or a transaction with us, including lost profits or loss of data, where such damages may lawfully be excluded.

For claims arising directly from a particular purchase, our aggregate liability will not exceed the amount paid to FTC Watercooling for the product or products giving rise to the claim, except where applicable law requires otherwise.

These limitations do not apply to liability that cannot lawfully be limited or excluded.

20. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold FTC PARTS LLC harmless from third-party claims arising from your unlawful use of the Site, violation of these Terms, infringement of another person’s rights, fraudulent activity, or misuse of content or services.

This provision does not require you to indemnify us for conduct for which indemnification cannot legally be required.

21. ELECTRONIC COMMUNICATIONS

When you place an order, create an account, submit an online form, or communicate with us electronically, you agree that we may provide transaction-related communications electronically, including through email or the Site.

Electronic records and communications may satisfy applicable requirements that information be provided in writing where permitted by law.

22. GOVERNING LAW AND DISPUTES

These Terms and transactions made directly through FTCWatercooling.com are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where another jurisdiction’s mandatory consumer-protection laws apply.

Where legally permitted, disputes arising from these Terms or direct purchases from FTC Watercooling will be brought in a court of competent jurisdiction located in Brevard County, Florida, or the applicable federal court having jurisdiction over that area.

Nothing in this section removes rights that applicable law does not allow a consumer to waive.

Before initiating formal proceedings, we encourage customers to contact us so that we have an opportunity to resolve the issue.

23. CHANGES TO THESE TERMS

We may revise these Terms periodically to reflect changes to our Site, business practices, products, services, or applicable requirements.

When these Terms are updated, the “Last Updated” date at the top of this page will be changed.

Changes apply prospectively from the date they are posted unless otherwise required by law.

24. SEVERABILITY

If any portion of these Terms is found to be unlawful, invalid, or unenforceable, that portion will be interpreted or limited to the extent necessary, and the remaining provisions will remain in effect.

25. NO WAIVER

Our failure to enforce a provision of these Terms on one occasion does not waive our right to enforce that provision or another provision in the future.

26. FORCE MAJEURE

To the extent permitted by law, we will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including severe weather, natural disasters, carrier disruptions, labor disputes, government actions, utility failures, internet or hosting outages, cyberattacks, supply-chain disruptions, or similar events.

27. ENTIRE AGREEMENT

These Terms, together with our Return Policy, Privacy Policy, and any other policies expressly incorporated into them, constitute the agreement governing direct use of the Site and purchases from FTCWatercooling.com.
